Subscription Changes and Cancellation

You may change or cancel your subscription at any time through your account settings. If you cancel, you may continue to use your subscription until the end of your current billing period, but you will not receive a refund for the current billing period.

  • any conduct or content of any third party on the service
  • any content obtained from the service
  • unauthorized access, use, or alteration of your transmissions or content

Limitation of Time to File Claims

Any cause of action or claim you may have arising out of or relating to these terms of use or the service must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.

Indemnification

You agree to defend, indemnify, and hold harmless LifeOSX, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms of Use.

Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any dispute arising from or relating to these terms or the Service will first be resolved through good-faith negotiations. If such negotiations fail, any controversy or claim shall be submitted to arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Diego, California.

Severability and Waiver

If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

Our failure to enforce any right or provision of these Terms of Use shall not be considered a waiver of those rights.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and LifeOSX regarding the Service and supersede all prior agreements and understandings, whether written or oral.
